THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.9660 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of the respondents in not providing alternative employment in terms of section 47 of the Persons with disability (equal opportunities, protection of rights and participation) Act 1995 as illegal, arbitrary & unjust and consequently direct the respondent to provide alternative employment i.e., As an Attender, shramik, Record Tressar, Shramik or any other suitable post with all consequential benefits." Heard, Sri G. Rajesh, learned counsel for the petitioner and Sri A. Ravi Babu, learned Standing Counsel for respondents. When the matter is called it is represented by learned counsel for the petitioner so also learned Standing Counsel for respondents that the issue in the present writ petition is squarely covered by an order passed by this Court in writ petition No.24560 of 2015, dated 27-08-2015 and a copy of the same is placed on record as material paper.
In view of the same and for the reasons recorded therein, this writ petition is disposed of, directing the respondentsCorporation to provide the petitioner with alternative employment by maintaining the pay scale of driver and also pay him the salary for the interregnum period i.e., from 09-06-2015 till he is provided with alternative employment. The entire exercise shall be completed by the respondents-Corporation within a period of eight
(8) weeks from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
