ORDER

This writ petition is filed seeking to issue a Writ of Mandamus declaring the action of the respondents in not considering the case of the petitioners for engagement as contract JLM in pursuance of the proceedings dated 24.05.2002, as arbitrary and illegal and consequently to direct the respondents to engage the services of the petitioners forthwith.

Heard Sri P.V.Krishnaiah, learned counsel appearing for the petitioners and Sri N.Siva Reddy, learned Standing Counsel appearing for the respondents.

The petitioners have been working in the respondentCompany since 10 years and in pursuance of the Board proceedings for considering them to absorb against 50% vacancies vide BPMS No.36, they appeared, got selected and stood at serial Nos.74 and 77 respectively.

The grievance of the petitioners is that 12 vacancies which are left out due to production of bogus certificates should be filled up with the selected candidates of the selected list.

Merely because the names of the petitioners are shown in the selected list, no right would be accrued in their favour to seek a writ of Mandamus. There are no merits in the writ petition.

Accordingly, the Writ Petition is dismissed. However, if the respondents are intending to fill up the vacancies, the petitioners should be given preference while appointing the candidates afresh. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
