HON'BLE SRI JUSTICE S.V. BHATT W.P.No.1339 OF 2015 ORDER:
The petitioners pray for Mandamus directing respondent No.3 to refer the petitioners' claim in the matter of payment of compensation to Civil Court under Section 30 of the Land Acquisition Act, 1894 (for short 'the Act') for adjudication of apportionment of compensation. The subject matter of the writ petition is an extent of Ac.4-26 gts in Sy.No.182/AA at Singapuram Village, Mancherial Mandal, Adilabad District.
The petitioners' have filed objection petition on 24.01.2015 for disbursement of compensation to respondents 4 to 7. The writ is filed against the alleged inaction of respondents.
At request of learned Government Pleader, the writ was adjourned to this date to enable the Government Pleader to get instructions in the matter.
The learned Government Pleader on the strength of written instructions submits that on 24.01.2015, the 3rd respondent received petition from the petitioners. The 3rd respondent on the petition dated 24.01.2015 intends to issue notice to both the parties and in case of title dispute, refers the matter to Civil Court under Section 30 of the Act for apportionment of compensation. It is stated that the writ is filed on apprehension. The stand of 3rd respondent is placed on record. The 3rd respondent to issue notice to both parties, consider the material placed by the parties and he is free to take a decision in accordance with Section 30 of the Act.
With the above observation, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
