HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.31827 of 2016 ORDER:

Vide the present petition, the petitioner seeks a mandamus declaring the action of respondent No.4, in refusing to return his original certificates, as illegal and arbitrary.

Learned counsel for the petitioner submits that, for the aforesaid relief, the petitioner made representation dated 20.06.2016 to respondent No.4, despite which, his original certificates have not been returned. It is stated in the writ affidavit that the petitioner pursued his MD course in Pharmacology. He was declared passed in the year 2014. However, the original certificates submitted at the time of admission have not been returned. Keeping in view the averments in the petition and the submission of the counsel for the petitioner, I hereby direct respondent No.4 to consider petitioner's representation dated 20.06.2016 and take action thereon within a period of one week from the date of receipt of a copy of this order. I hereby make it clear that, if respondent No.4 has any reservation in returning the original certificates of the petitioner, the decision taken shall be communicated to him.

I further make it clear that, if the petitioner is still aggrieved by the action or inaction of respondent No.4, he may approach appropriate forum.

With the above direction, the Writ Petition stands disposed of.

Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
