THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.36522 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "......to issue a writ or order/s more particularly one in the nature of Writ of Mandamus declaring the action of the respondent authorities in seeking to dispossess the petitioner from her property bearing municipal no. 6-3-72/3 situated at Balanagar village of Balanagar mandal in Ranga Reddy district, without resorting to provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013, as being illegal, arbitrary and violative of article 300-A of the Constitution of India; and consequently to direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner over the said property without due process of law; and be pleased to pass such other order/s as this hon'ble court may deem fit and proper in the circumstances of the case."

At the hearing, Sri B. Vijaysen Reddy, learned counsel for the petitioner, would submit that after institution of this Writ Petition, a notice under Section 146 of Greater Hyderabad Municipal Corporation Act, 1955, was issued; and, in that view of the matter, no cause survives for adjudication in this Writ Petition, as this Writ Petition is filed apprehending action without issuance of a notice. 3.

Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondent Nos.2 and 3 is present.

Recording the submissions, the Writ Petition is disposed of as infructuous, in view of the subsequent event.

MSRM, J W.P.No.36522 of 2017 Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.

There shall be no order as to costs.
