THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6504 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings in Crime No.433 of 2016 on the file of Prohibition and Excise Station, Dhoolpet, Hyderabad, registered for the offence punishable under Sections 7(A) r/w 8(e) of A.P. Prohibition Act and 34(e) of A.P. Excise Act, 1968 r/w Section 109 IPC.

Heard and perused the material available on record. It is alleged that A1 was found conducting illicit distillation and A1 was also found in possession of contraband and 250 litres of fermented jaggery wash ready for distillation. A1 disclosed that A2 supplied 30 kgs of black and rotten jaggery.

Considering the facts and circumstances of the case and nature of the offence, this Court is not inclined to grant the relief sought by the petitioner, However, the 2nd respondent-police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioner. In the event of necessity, the 2nd respondentpolice are directed to issue a notice to the petitioner to appear before the investigating agency for the purpose of investigation. On issuance of such notice, the petitioner is directed to appear before the investigating agency and give an undertaking as to appearance as and when required for the purpose of investigation. Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
