THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.38409 of 2017 ORDER:

The petitioner joined the Hyderabad Urban Development Authority (HUDA) as Surveyor on 04.05.1983.

Thereafter he was promoted as Architectural Draughtsman on 16.11.1992 and as Junior Planning Officer on 15.12.2003. The petitioner states that now he is eligible for further promotion to the post of Assistant Planning Officer. He alleges that departmental proceedings were initiated against him, and the same are pending. It is the case of the petitioner that his case is not considered for promotion even though he is eligible, only on the basis of pendency of departmental proceedings against him. Challenging the same, the present Writ Petition is filed. In the circumstances, the Writ Petition is disposed of directing the respondents to consider the case of the petitioner for promotion, if he is otherwise eligible and if there is no rule prohibiting his consideration because of pendency of departmental proceedings. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
