THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION Nos.37065 of 2017 & 40444 of 2017 COMMON ORDER:
In these two writ petitions, the case of the petitioners is that their objections shall be considered while processing the application filed by the 3rd respondent for grant of layout of the property in Survey No.568, situated at Pati Ghanpur Village, Patancheruvu Mandal, Medak District. In the first writ petition, a request was made to consider the said objections and in the second writ petition, the inaction of the official respondents 1 & 2 in not considering the said representation/objections, dated 27.10.2017, is assailed. 2.
I have heard the submissions of Sri Pottigari Sridhar Reddy, learned counsel appearing for the petitioners, learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent, Sri Y.Rama Rao, learned Standing Counsel for the Hyderabad Metropolitan Development Authority (HMDA), appearing for the 2nd respondent, and of Sri G.Tirupathi Reddy, learned counsel appearing for the 3rd respondent. I have perused the material record.

Learned counsel appearing for the petitioners and the learned counsel appearing for the 3rd respondent would submit that if a direction is given to the respondents 1 & 2 to consider the representation, dated 27.10.2017, of the petitioners while processing the application filed by the 3rd respondent for grant of layout of the property in Survey No.568, situated at Pati Ghanpur Village, Patancheruvu Mandal, Medak District, the ends of justice would be met.

Recording the submissions, both the Writ Petitions are disposed of directing the 2nd respondent to consider and dispose of the representation, dated 27.10.2017, of the petitioners while considering the request of the 3rd respondent for grant of layout of the property in Survey No.568, situated at Pati Ghanpur Village, Patancheruvu Mandal, Medak District, however, in strict accordance with procedure established by law. The said exercise shall be completed by the said authority within a period of four (04) weeks from the date of receipt of a copy of this order. The 3rd respondent is directed not to take any development activity in the subject property covered by the proposed layout, until the layout permission is granted, in accordance with procedure established by law.
