Heard counsel for petitioner and Sri Sampath Prabhakar Reddy, Standing Counsel for respondents 2 and 3. 2.
The grievance of the petitioners is that the respondents are not receiving and processing the application for building permission for their land and insisting on the petitioners for submission of 'No Objection Certificate' from the District Collector.

In Hyderabad Potteries Private Limited v. Collector, Hyderabad1 this Court has held that a local authority has no competence to insist on production of No Objection Certificate from the revenue authorities as a pre-condition for processing and considering an application for permission for construction of a building.

In this view of the matter, the Writ Petition is disposed of directing the respondents to receive and process the application of the petitioners for building permission without insisting on submission of No Objection Certificate from the revenue authorities. There shall be no order as to costs. 1 2001(3) ALT 600

Consequently, miscellaneous petitions pending if any shall stand closed.
