The Court made the following:

ORDER:

Petitioner claims to be physically handicapped person belonging to Scheduled Caste and after obtaining permission from Gram Panchayat, raised a tin shed Opp:Andhra Bank, Chigurumamidi village and mandal, Karimnagar district and eking out his living therein by running a tea stall. That on 6.1.2015 without prior notice or opportunity the tin shed was dismantled and petitioner was thrown out of the premises and as consequence to such dismantling he became helpless and is unable to eke out his living. Hence, this writ petition. Learned counsel for petitioner contends that petitioner who is handicapped person was illegally dispossessed from the premises where he was carrying his livelihood and he was granted due permission from the Gram Panchayat and was paying taxes to the Gram Panchayat.

He further submits that in accordance with the scheme formulated by the Government of Telangana, petitioner is entitled for grant of patta on the subject property and on account of illegal dismantling of the structure and dispossessing him grave prejudice is caused. He further submits that ventilating his grievance, petitioner submitted a representation dated 12.1.2015 to the District Collector and so far the same is not disposed of.

Having regard to the fact that the representation submitted by the petitioner is pending and same is yet to be acted upon, writ petition is disposed of without expressing any opinion on the merits of the matter and directing the second respondent to consider the representation of the petitioner dated 12.1.2015 and pass appropriate orders as warranted by law duly taking note of G.O.Ms.No.58 dated 30.12.2014 and communicate the decision to the petitioner within a period of four weeks from the date of receipt of copy of this order.
