THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9525 of 2016 ORDER:

This Criminal Petition is filed by the petitioner, under Section 438 of the Criminal Procedure Code, seeking anticipatory bail in Crime No.32 of 2016 on the file of Nandigam Police Station, Srikakulam District, registered for the offences punishable under Sections 417, 420, 376 and 109 IPC.

The allegation against the petitioner is that on promising to marry the de facto compliant, who is a minor, he had sexual relationship with her, due to which she gave birth to a female child and when she asked to marry her, he refused to marry her. When the matter is taken up, it is represented that the earlier bail application i.e. Crl.P. No.8254 of 2016 filed by the petitioner was dismissed by this Court on 20.06.2016.

Since the earlier bail application of the petitioner was dismissed and there is no substantial change in the circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J July 12, 2016.
