HONOURABLE SRI JUSTICE N.V.SHRAVAN KUMAR WRIT PETITION No. 19022 OF 2015 ORDER:

This writ petition is filed declaring the inaction of the respondent Nos.2 to 4 on the petitioner representation dated 08.11.2013 to allot/assign any clear government land of 5/10 acres useful for agricultural operations or to allot/assign any residential clear Government land of 500/1000 sq. yards for the residential use of the petitioner within the periphery of present place of residence.

Learned counsel for the petitioner submits that petitioner is a freedom fighter family pension holder vide 05-PoI/FF 000102 dated 04-10-1980, as the petitioner's husband does not avail any other benefits of the freedom fighter's scheme, petitioner applied for an agricultural land allotment near to her place of residence. 3.

Learned counsel for the petitioner submits that the then Government of Andhra Pradesh after careful consideration allotted petitioner an extent of only 3 acres 14 guntas agricultural land in Sy.No.110 of Narsapur Village, Siddipet Mandal, Medak district and issued patta certificate dated 21.12.2000. Later respondent No.2 issued cancellation of allotment proceedings on assumptions

and presumptions that petitioner's son is working as village Patwari. Learned counsel for the petitioner further submits that without issuing notice to the petitioner, patta granted earlier was cancelled and while cancelling the allotment the respondent Nos.3 and 4 allotted 300 sq. yards of house plot in favour of the petitioner along with allotment order a sketch was also attached. However, the possession of said land was not given to the petitioner as some other persons have occupied it. 4.

Learned counsel for the petitioner further submits that petitioner filed an application dated 08.11.2013 to respondents No.2 to consider the request for re-allotment of any other agricultural land or residential house for petitioner's use and the same is still pending. Learned counsel for the petitioner further submits that in view of the representation/application of the petitioner dated 08.11.2013 is pending, prays the Hon'ble Court to pass appropriate orders.

Learned Assistant Government Pleader for Revenue submits that the respondents would consider petitioner's representation dated 08.11.2013 and pass appropriate orders in accordance to law.

Recording the submission of learned counsel for the petitioner and learned Assistant Government Pleader for Revenue this writ petition is disposed of directing the respondent Nos.2 to 4 to consider petitioner representation dated 08.11.2013, by taking the age factor of the petitioner into consideration, and give a fair opportunity to the petitioner to make her submissions with respect to the allotment of either agricultural land or residential plot and pass orders in accordance with law as expeditiously as possible within a period of eight (8) weeks from the date of receipt of copy of the order.

Accordingly, this Writ Petition is disposed of. Miscellaneous applications, if any pending, shall stand closed. No order as to costs.
