DURGA PRASAD RAO Writ Petition No.5175 of 2016 ORDER: (Oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) On the last date of hearing i.e, 19.06.2017, learned counsel for the petitioner submitted that vide proceedings No.SCR/P-SC/122/ACG/164/ 2016/AC dated 06.06.2017, the Divisional Railway Manager/SC has approved for appointment on compassionate grounds in favour of the deceased first respondent's son Shaik Haji Miya. Accordingly, directed for pre-employment medical examination on 07.06.2017. The matter was adjourned on the said date to ascertain whether employment is issued in favour of the deceased first respondent's son Shaik Haji Miya or not.

Learned counsel appearing on behalf of the petitioner submits that till date pre-employment medical examination has not yet been conducted and as and when conducted, case of the respondents shall be considered.

Learned counsel appearing on behalf of the respondents has no objection if the present petition is disposed of in view of the statement made by learned counsel for petitioner.

On assurance given by the learned counsel for the petitioner, we hereby dispose of the petition with a direction to the petitioners to conduct the pre-employment examination within four (4) weeks from the date of receipt of a copy of this order. No costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand closed.
