THE HON'BLE JUSTICE T.AMARNATH GOUD CRIMINAL PETITION No.11497 of 2018 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioners/Accused Nos.1 to 7 seeking to quash the proceedings against them in C.C.No.2582 of 2017 on the file of IV Additional Judicial Magistrate of First Class, Warangal. 2.

Heard the learned counsel for the petitioners/Accused Nos.1 to 7, the learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Having regard to the facts and circumstances of the case and on perusal of the material available on record, this Court feels that the contents in the charge sheet are more serious against 1st petitioner/ A-1 viz., Malyala Mallaiah, who is the husband of the complainant, and in view of the same, he is not entitled to any relief and accordingly the Criminal Petition is dismissed against 1st petitioner/A-1. 4.

At this stage, the learned counsel for the petitioners restricts his prayer seeking dispensation of personal appearance of the remaining petitioners/Accused Nos.2 to 7 before the Court below. 5.

Considering the said submission, without expressing any opinion on the merits of the case, the personal appearance of the petitioner Nos.2 to 7/A-2 to A-7 in C.C.No.2582 of 2017 on the file of IV Additional Judicial Magistrate of First Class, Warangal, is dispensed

with, while permitting them to make their appearance through counsel. However, they shall appear before the Court below as and when their personal appearance is so warranted, in respect of the aforesaid Calendar Case. The trial Court shall proceed with the case in usual course. 6.

With the above direction, the Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
