2018-11-01M.S.Ramachandra Rao2 pages

THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.39115 of 2018 O R D E R:

Heard counsel for petitioner, Sri D.Ravi Shankar Rao, Standing Counsel appearing for 1st respondent and Sri K.Aravind Kumar, Standing Counsel appearing for 3rd respondent.

2.

Petitioner has filed this Writ Petition assailing his transfer from the 1st respondent's unit at Hyderabad to another Unit at Ajmer, Rajasthan State.

3.

Though counsel for the petitioner places reliance on the Standing Orders and contended that the Standing Orders referred to only Hyderabad Unit and therefore there cannot be a transfer to another Unit in Rajasthan, counsel for respondents 1 & 2 has placed before me an Office Order No.39/2010 dt.19.02.2011 setting out transfer policy. 4.

Clause 14.1 in the said policy states that the management reserves right to transfer any employee any time to any Unit within the Country.

5.

Having regard to the said transfer policy by the 1st respondent, it cannot be said that the transfer of the petitioner from Hyderabad to Ajmer is prohibited.

6.

Accordingly, this Writ Petition fails and is dismissed. No order as to costs.

7.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
