HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.39151 of 2018 ORDER:

It is the case of the petitioner that he made a representation on 20-06-2018 to the respondents for cancellation of registered sale deed bearing document No.1699 of 2007, dated 04-05-2007 as the same was executed illegally without having any right over the subject property by respondents 3 to 5 in favour of 6th respondent. As no action has been taken, the present writ petition is filed. Learned counsel for the petitioner has not shown any provision of law empowering the 2nd respondent to cancel the registered sale deed. Learned Assistant Government Pleader for Revenue also submits that once registration of document is done, the same cannot be cancelled by them unilaterally and parties have to approach the civil Court.

In view of the same, I do not see any reason to entertain the writ petition and accordingly the same is dismissed. However, it is open for the petitioner to avail alternative remedies available to him under law. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
