HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.14017 OF 2015 ORDER:

Petitioner claims to be the owner and in possession of the house site property bearing Door No.15-22-100/2, Kotla Bazar, opposite to Tamil Nadu Bank, Chirala, Prakasam District. The 6th respondent is the neighbour having house site property bearing Door No.15-22-104. The grievance of the petitioner is that 6th respondent is undertaking unauthorized construction of building of five floors apartment without leaving any setbacks, without taking fire safety measures and preventing circulation of air and ventilation. Aggrieved by the said alleged illegal actions, petitioner claims to have submitted a report on 05.03.2015 to the respondents 2 and 3. Contending that no further action is initiated on the report submitted by the petitioner, this writ petition is instituted.

2. When the matter is taken up for consideration, learned standing counsel representing the respondent-municipality, submits that notice was issued to the 6th respondent against the unauthorized constructions and later confirm notice was also issued and further action is being taken in accordance with Section 228 of Andhra Pradesh Municipalities Act, 1965.

3. Having regard to the said statement of the learned standing counsel, the grievance of the petitioner in the writ petition does not survive and has become infructuous and is accordingly disposed of.
