Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4. This Writ Petition is filed seeking to declare the action of the 2nd respondent in not passing any orders either in the stay application or in the appeal, as arbitrary and illegal.
Learned counsel appearing for the petitioner submits that no specific charge has been levelled against the petitioner and no show cause notice was issued before cancelling the authorization. On the other hand, learned Government Pleader for Civil Supplies appearing for the respondents submits that notice was issued by the Revenue Divisional Officer to the petitioner to attend for enquiry on 5.3.2015.
From a perusal of the impugned order, it is clear that no show cause notice was issued to the petitioner making specific allegations. However, the petitioner preferred an appeal before the 2nd respondent-Joint Collector, Kurnool, and the same is pending.
Since the appeal is pending before the 2nd respondent, the 2nd respondent is directed to dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
