THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4016 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in crime No.40 of 2016 on the file of the Police Station, Pusapatirega, Vizianagaram District, registered for the offences under Sections 354, 324, 323, 447, 143, 506(2) IPC read with Section 34 IPC and Sections 3(1)(r), 3(1)(s), 3(1)(w)(1), 3(2)(v)(a) and 3(1)(g) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act.

Heard and perused the material.

A reading of the complaint does not disclose that there is quarrel between the accused and the de facto complainant regarding the ownership of the land, which is alleged to be purchased by the petitioners herein. Further, the allegations made against the petitioners are not so serious in nature and as such, the same does not necessitate the arrest of the petitioners herein.

Considering the facts and circumstances of the case, the police are directed to complete the investigation without arresting the petitioners and file final report, if any, in accordance with law. The police are directed to issue notice to the petitioners for their appearance for the purpose of investigation and the petitioners are also directed to appear and cooperate with the investigating agency. The petitioners are also directed to submit an Undertaking for their future appearance for the purpose of investigation. The Criminal Petition is accordingly disposed of.
