HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.43388 OF 2016 ORDER:

The grievance of the petitioner is that he filed appeal along with stay petition against impugned proceedings dated 19-09-2016, whereby authorization of fair-price shop of the petitioner has been suspended. As no orders are passed, the present writ petition is filed. Learned counsel for the petitioner submits that though variations are within permissible limits, without considering the same stocks were seized. Though statutory appeal is filed along with stay petition, no orders are passed on the same.

Heard learned Assistant Government Pleader for Civil Supplies.

In view of above facts and circumstances, the 2nd respondent is directed to dispose of the appeal filed by the petitioner within a period of eight weeks from the date of receipt of a copy of this order. Till then, there shall be stay of impugned proceedings. However, this will also not preclude the 3rd respondent-Revenue Divisional officer from conducting enquiry and passing final orders.

With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
