HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI WRI T PETI TI ON No.37108 of 2017 ORDER:

In this writ petition, under Article 226 of the Constitution of India, the complaint of the petitioner is against the action of respondents 2 and 3 in allowing respondent No.4 to establish and operate a wine shop with permit room in Ward No.83 instead of Ward No.82 of Golnaka by wrongly mentioning the premises number as H.No.2-3-672/A instead of H.No.2-4-674.

At the hearing, learned counsel for the petitioner would submit that if a direction is given to respondents 2 and 3 to prevent such action of the fourth respondent, the grievance of the petitioner would be redressed. However, learned Government Pleader appearing for respondents 1 to 3 would submit that though unofficial respondent/fourth respondent is the selected applicant for A4 shop in Ward No.82, but so far he has not made any application in respect of the premises bearing H.No.2-3-674 by wrongly mentioning it as H.No.2-3-672/A for grant of A4 shop licence or permit room licence as mentioned in the writ petition and that the writ petition is filed only on an apprehension.

Recording the said submissions, the Writ Petition is disposed of directing respondents 2 and 3 to allow the fourth respondent to establish A4 shop, if he is otherwise permitted, only in Ward No.82 of Golnaka.
