THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.37714 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home.

The petitioner is the wife of Sri Medishetty Narayana Rao, who is stated to have been detained under A.P. Act No.1 of 1986 in Charlapally Jail. The petitioner's husband intended to execute a General Power of Attorney (GPA) in her favour so as to protect his house property and sought execution and registration of Power of Attorney for which a request was made to the Superintendent of Central Jail, Charlapally, the 3rd respondent, who forwarded the said request to the SubRegistrar of Assurances, Uppal, Ranga Reddy, the 2nd respondent. The grievance of the petitioner in this case is that the 2nd respondent is not completing the registration of GPA in her favour by her husband, who is stated to be Detenue No.306 and, therefore, she approached this Court by filing the present Writ Petition.

Learned Government Pleader for Home, on instructions, submits that though the 2nd respondent visited Cherlapally Jail, the petitioner's husband was not found therein and is stated to have been shifted to Chanchalguda Jail. It is also stated that the said Detenue has been transferred to Central Prison, Hyderabad, on 07.11.2015 as per the orders of the Director General of Prisons and Correctional Services, Hyderabad, dated 02.11.2015 and as far as the registration is concerned, the instructions show that the matter is entirely in the purview of registration authorities.

Learned Government Pleader, therefore, submits that the Jail Authorities of Central Prison, Chanchalguda, where the Detenue is now lodged, shall give appropriate permission to the 2nd respondent to visit him and complete the registration of the document, as requested by the petitioner.

In view of the same, the Writ Petition is disposed of directing the 2nd respondent to visit the Central Prison, Chanchalguda, where the Detenue is stated to have been lodged presently, and the 4th respondent shall permit the registration authorities and the petitioner to visit the Detenue for the purpose of execution and registration of the aforesaid document on a date to be fixed by the 2nd respondent, preferably within a period of two weeks from the date of receipt of a copy of this order. The date so fixed shall also be intimated to the 2nd respondent and the petitioner. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
