HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.39023 OF 2018 ORDER :

This writ petition is filed challenging the action of the respondent No.4 in issuing the impugned notices dated 12.10.2018 and 27.10.2018, under Section 7 of the A.P.Land Encroachment Act, 1905 calling upon the petitioner to show cause within 7 days from the date of such notice as to why the petitioner should not be penalized for occupation, under Section 5 of the Act III of 1905 and as to why the petitioner should not be evicted from the premises to an extent of Ac.0.02 cents, Survey No.215, situated in Mattaparru Village, Poduru Mandal, West Godavari District. The grievance of the petitioner is that though he filed explanation to the notice, without considering the same the respondents are trying to evict the petitioner from the subject land.

Heard both sides.

In view of the facts and circumstances, the 4th respondent is directed to consider the explanation of the petitioner and pass orders, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Till passing of orders, Status-quo, obtaining as on today shall be maintained regarding possession of the subject land.

Accordingly, the writ petition is disposed of. No order as to costs.
