ORDER

The present criminal revision case is directed against the docket order dated 22.12.2015 passed in P.R.C.No.7 of 2015 on the file of Judicial Magistrate of First Class, Vayalpad.

2. Heard and perused the material on record.

3. The petitioner/A12 is involved in Cr.No.12 of 2014 of Kalakada Police Station, Chittoor District, registered for the offences punishable under Sections 147, 148, 353, 341, 307 120(b) read with Section 149 IPC and 379 IPC and under Section 27 of A.P.Forest Act and under Section 3 of Sandal and Red Sandal Wood Transit Rule, 1989 and Section 27(1)(B) of Indian Arms Act. After completion of investigation, charge sheet was filed and the case was taken on file as P.R.C.No.7 of 2015, wherein NBW was issued against the petitioner/A12 and other accused by the order impugned. Challenging the same, the present revision is filed.

4. Issuance of NBW is to secure the attendance of the petitioner before the Court. As the petitioner expressed his willingness to appear before the Court below regularly, the NBW issued against him can be recalled.

5. The Criminal Revision Case is disposed of, with the following direction;

The petitioner/A12 is directed to surrender before the Court below on or before 30.01.2016 and make an application for

recalling of NBW pending against him. On filing such an application, the Court below shall recall the warrant on the petitioner executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with one surety for a like sum to its satisfaction, failing which, the Court below is at liberty to take appropriate steps. Till such time, the warrant issued against the petitioner is hereby suspended. The petitioner herein is further directed to appear before the Court below on each and every date of adjournment.

Miscellaneous Petitions, if any, pending in this revision shall stand closed.
