HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39082 of 2018 ORDER:

1) Heard.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.2 in interfering with peaceful possession and enjoyment of the plot admeasuring 15'19'' area which kept aside for compound wall of the house bearing No.10-1-59/1 of Rayadurg Municipality, Anantapuramu District, as illegal and arbitrary. 3) Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to consider the representation dated 11.12.2017, made by the petitioner, at the earliest.

4) Sri Md.Saleem, learned Standing Counsel for Municipality states that he has no objection for the same. Further, on instructions, he states that the authorities have already laid the road without interfering with the land of the petitioner and that even as on today they are not interfering with the land of the petitioner. He however pleads that representation dated 11.12.2017, if made and is still pending consideration, the same may be directed to be disposed of, at the earliest.

5) Having regard to the above submissions, the writ petition is disposed of directing the respondent - authorities to deal with the representation dated 11.12.2017, if made by the petitioner and if it is still pending consideration, at the earliest, in accordance with law. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
