THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI WRI T PETI TI ON No.29660 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed by the unsuccessful applicant in O.A.No.3281 of 2016 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. By order dated 24.08.2016, the Tribunal dismissed the said O.A. taking note of the fact that the representation made by the petitioner/applicant was pending before the Government and observing that the Government may dispose of the same as expeditiously as possible and within reasonable time.

Learned Government Pleader for Services (TG) informed this Court that the Government of Telangana had already considered and rejected the representations dated 16.04.2016 and 20.04.2016 made by the petitioner/applicant. The Memo bearing No.1201/V&F/A1/2016 dated 06.09.2016 is placed before us in proof of the rejection of the petitioner/applicant's representations.

In the light of the aforestated developments, a fresh cause of action would arise if the petitioner/applicant is aggrieved by the aforestated Memo dated 06.09.2016. Any such cause would necessarily have to be addressed in the first instance before the Tribunal constituted under the Administrative Tribunals Act, 1985, in the light of the law laid down by the Supreme Court in L. Chandra Kumar v. Union of I ndia1. Reserving liberty to the petitioner to do so, the writ petition is dismissed. Needless to state, the grievance of the petitioner, if any, shall be addressed by the Tribunal on merits without being influenced by any 1 (1997) 3 SCC 261

observations made in the order dated 24.08.2016 passed in O.A.No.3281 of 2016.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
