Heard learned counsel for the petitioner and learned Government Pleader for Revenue for respondents. 2.

Petitioner claims that her husband was granted land in the year 1976. During his life time, he raised Mango, cashew and teak trees. On 25.06.1985, he has made a representation, for assignment of land. While so, the National Highway authorities, in the process of widening of national highway removed the trees without notice and opportunity to the petitioner. It is alleged that a legal notice was issued on 27.08.2017. Alleging inaction on the legal notice caused, this writ petition is filed.

Except enclosing a copy of the land cist stated to have been collected from the petitioner on 29.12.2007, no other material is filed in support of the claim that petitioner is in possession of land and illegally petitioner is sought to be dispossessed and the trees standing on the land are removed. Further a reading of Paragraph No.2 of the affidavit, it appears that land was granted to the husband of petitioner in the year 1976. In the absence of any material to show that petitioner is owner or/and in possession of the subject land and that there are grown up trees which are being removed illegally, no relief as sought for can be granted.

The writ petition in the present form is not maintainable and is liable to be dismissed. Accordingly, the Writ Petition is dismissed. Pending miscellaneous petitions shall stand closed. __________________ P.NAVEEN RAO,J 31st October, 2018 Rds
