RESPONDENT ORAL ORDER This criminal petition is filed by the petitioner/accused No.1 seeking anticipatory bail in connection with Crime No.175 of 2025 of Asifnagar Police Station, Hyderabad. 2.

The brief facts of the case are that, on 21-07-2025, the de-facto complainant lodged a report stating that while he was at his Congress Party Office in New Kishan Nagar, one person named Shoiab, along with 15 to 20 others, illegally entered the premises. They damaged property inside the office and

assaulted him using hands, sticks, and belts. As a result, he sustained a fracture injury to his right hand, bleeding injuries on his left palm, right hand, left side of the head, and ribs. They also damaged his two-wheeler vehicle, which was parked in front of the office, due to which he requested that legal action be taken. Based on the said complaint, the police registered a case vide Crime No.175 of 2025. Pursuant to the confession of the primary accused, the petitioner and other individuals were arrayed as accused. The petitioner was identified as an abettor in the commission of the said offence. Consequently, charges were framed under Sections 118(2), 329(4), 324(4), and 49 read with Section 190 of BNS. 3.

Heard Sri M.A. Mujeeb, learned counsel for the petitioner and Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner has no connection whatsoever with the alleged offence and was not present at the scene when the incident occurred and that the jurisdictional police station did not register the case initially, raising doubts about the credibility of the allegations. He further submitted that the mere

pendency of other cases against the petitioner cannot be treated as a valid ground for denial of anticipatory bail, particularly when the present complaint does not prima facie disclose the commission of any grave offence. Therefore, he prayed the Court to grant the relief of anticipatory bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that several criminal cases were pending against the petitioner from 2005 to 2025 and that a rowdy sheet had also been opened against him. He further pointed out that earlier bail application of the petitioner had already been dismissed and that the investigation in the present case was still in progress. Hence, he prayed the Court to dismiss the criminal petition.

Having regard to rival submissions made, and on going through the material placed on record, it is noted that thirty criminal cases are pending against the petitioner, out of which four are pending and a rowdy sheet has also been opened against him. In view thereof, this Court is of the opinion that granting pre-arrest bail at this stage, when the investigation is

still underway, may hinder the investigative process and potentially prejudice the case of the prosecution. Therefore, this Court finds no merit in the present criminal petition, and the same is liable to be dismissed.

However, taking into account the overall facts and circumstances of the case, this Court deems it fit to direct the petitioner to file surrender petition before the concerned trial Court, and on filing of such petition, the trial Court is directed to consider the same as expeditiously as possible and pass appropriate orders in accordance with law.

With the above directions, this Criminal Petition is disposed of.

Miscellaneous petitions, pending, if any, shall stand closed.
