HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.37451 OF 2017 O R D E R :

This petition is filed with the following prayer: " ...to issue a Writ, order or direction more particularly one in the nature of writ of mandamus declaring the in action of the respondents 2 to 4 in refusing to release the Domestic Load/power supply to the petitioner's premises in H.No.1-60/2/9, Plot bearing No.1, in Survey No.28, 29 and 30 of Madhapur Village, Serilingampally Mandal, Ranga Reddy District on the ground of non furnishing of occupancy certificate as illegal, arbitrary, highhanded, apart from being violative of Article 14 of the Constitution of India and consequently set aside the same and to pass such other order or orders as this Hon'ble Court may deems fit and proper in the circumstances of the case." Heard learned counsel for the petitioner who submits that the 'lis' in the writ petition is squarely covered by the order dated 14.09.2017 passed by this Court in WP.No.31189 of 2017; and the same is not disputed by Sri R.Vinod Reddy, learned Standing Counsel for respondents 2 to 4.

Sri Sampath Prabhakar Reddy, learned Standing Counsel appeared for the 5th respondent.

Recording the aforesaid submission of the learned counsel, the writ petition is disposed of with a direction to respondents to release the power supply to the premises of the petitioner subject to the compliance of the terms and conditions of supply and on

furnishing an undertaking to produce the occupancy certificate from the concerned Municipality/Municipal Corporation, within a period of three months, and if no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
