Heard Sri D. Krishna Murthy, learned counsel for the petitioner, learned Government Pleader for respondent No.1, Sri R. Vinod Reddy, learned Standing Counsel for Respondent Nos. 2 and 3, learned Assistant Solicitor General appearing for R.4 and Sri P. Shiv Kumar, learned Standing Counsel for Respondent No.5.
The case of the petitioner is that he is having three separate units of Sugar Crushing, Co-Generation Power Unit and Distillery in one compound and there is a single power supply connection to the above said units. The respondent No.4 passed closure Order in respect of his Distillery unit and in pursuance of the same, he closed the entire unit while complying the deficiencies pointed out by respondent No.4 for revocation of the order. As the sugar cane crushing season started, the petitioner made a representation to the authorities for providing power supply to Sugar Cane Crushing Unit alone and based on the representation of the petitioner, the authorities concerned have already passed feasibility Order dt. 27.10.2017.
Learned Standing Counsel for respondent Nos. 2 and 3 submits that basing on the Order of respondent No.5, the power supply was disconnected to the factory of the petitioner. Learned Standing Counsel for Respondent No.5 submits that basing on the Order of respondent No.4, it has issued Orders to respondent Nos. 2 and 3 to disconnect power supply to the factory of the petitioner.
It is to be seen from the material on record, it is for respondent No.2 to take action on the representation made by the petitioner with
regard to feasibility to extend power supply to the unit of Sugar Cane Crushing Unit.
In view of the same, this Writ Petition is disposed of directing respondent No.2 to dispose of the representation of the petitioner and pass appropriate orders, in accordance with law, within a period of two weeks.
The miscellaneous Petitions, if any, pending in this case shall stand closed.
