Jaldi Mohan, v. Duddu Manikyala Rao,
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY Second Appeal No.443 of 2015 Dated 10th July, 2015 Between:
Jaldi Mohan ...Appellant and Duddu Manikyala Rao
...Respondent
Counsel for the appellant: Sri Naga Praveen Vankayalapati Counsel for the respondent: ---- The Court made the following:
JUDGMENT:
This second appeal arises out of the concurrent judgements and decrees of the Courts below in O.S.No.977 of 2010 and A.S.No.89 of 2013.
The necessity for this Court to deal with the merits of the case is obviated for the reason that the consistent stand of the appellant before the Courts below as stated by his counsel, Sri Naga Praveen Vankayalapati, before me is that he is in no way concerned with the suit schedule property. If the appellant is not interested in the suit schedule property, the decree for injunction granted in favour of the respondent against him would not in any manner affect his interests. Therefore, to my mind, the reason for the appellant to have made all the efforts to approach this Court by filing the second appeal in order to question the judgments and decrees of the Courts below, is unnecessary as on his own showing, he is in no way affected by the judgments under appeal. Accordingly, the second appeal is dismissed.
As a sequel to dismissal of the second appeal, S.A.M.P.No.1165
of 2015 shall stand disposed of as infructuous. C.V.NAGARJUNA REDDY, J 10th July, 2015 VGB
