The present writ petition is filed seeking a direction to the Sub-Registrar for registration of sale deeds in respect of subject lands.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Revenue submits that guidelines were laid down in Full Bench Judgment of this Court in W.A.No.353 of 2015 and Batch, dated 23-12-2015 to deal with several issues regarding inclusion and deletion of lands in the prohibited list. A reading of Division Bench Judgment of this Court in WP.No.22602 of 2008 and Batch, while following Full Bench Judgment of this Court in W.A.No.353 of 2015 and Batch in para No.3 in Clause (ix) it is held as follows: " It is open to the parties to a document, if the relevant property/land finds place in the list of properties covered by clauses (a) to (d) of sub-section
(1) of Section 22-A, to apply for its deletion from the list or modification thereof, to the concerned authorities as provided for in the guidelines. The concerned authorities are obliged to consider the request in proper perspective and pass appropriate order within six weeks from the date of receipt of the application and make its copy available to the concerned party." In view of the same, already reports are before the District Collector and the District Collector is concerned authority for inclusion of the same in the prohibited list. Having regard to the above, the 3rd respondent is
directed to take action on the representation of the petitioner dated 17-10-2015 by taking into account the report of Tahsildar dated 12-11-2015 and report of the Revenue Divisional Officer, dated 13-11-2015 within a period of four (04) weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 17-08-2016 nvl
