THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34634 OF 2017 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Transport (Telangana) for the respondents. 2.

When the matter is called, it is brought to the notice of this Court that in identical circumstances, this Court disposed of W.P.No.5582 of 2010 by way of an order, dated 11.03.2010. A copy of the same is filed along with writ material papers. The operative portion of the said order reads as under: "Accordingly, the respondents are directed to release the vehicle in question forthwith to the interim custody of the petitioner subject to the condition of the petitioner paying Rs.10,000/- (Rupees Ten Thousand only) and also on production of original documents besides furnishing an undertaking to the effect that he would not transfer the vehicle pending enquiry and that he would produce the vehicle as and when the same is required by the respondents-authorities in the course of enquiry and investigation. It is made clear that the above order does not preclude the authorities from proceeding with the enquiry."

Following the said order and for the reasons stated therein, this writ petition is also disposed of in terms thereof. There shall be no order as to costs.

Office to enclose a copy of the order, dated 11.03.2010, in W.P.No.5582 of 2010 to this order.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
