THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.38493 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "For the reasons stated in the accompanying affidavit the petitioner herein prays that this Hon'ble Court may be pleased to issue appropriate Writ or any other order or direction particularly one in the nature of Writ of Mandamus, declare the action of the Respondent No.3 in not renewing the fitness of the Petitioner vehicle TS-15-UA-3498 in spite of his repeated requests is arbitrary, illegal, unconstitutional and consequently direct the Respondent No.3 to renew the fitness of the Petitioner vehicle at the earliest and pass such other order or orders as deemed fit and proper in the circumstances of the case and in the interest of justice." (Reproduced verbatim) 2.

I have heard the submissions of Sri Malugari Sudarshan, learned counsel appearing for the petitioner, and of the learned Government Pleader for Transport (Telangana) appearing for the respondents 1 to 3.

When this writ petition is taken up for hearing, learned counsel for the petitioner submits that in similar circumstances, this Court allowed W.P.No.9570 of 2017, dated 06.04.2017, and the same is not disputed by the learned Government Pleader for Transport. 4.

In view of the same, this Writ Petition is also allowed in terms of the order, dated 06.04.2017, passed by this Court in WP.No.9570 of 2017, directing the respondent authorities to allow the petitioner forthwith to submit his application through online and process the same, as expeditiously as possible, and complete the testing formalities, within a period of two (02) weeks from the date of receipt

MSRM, J W.P.No.38493 of 2017 of a copy of this order. This Court makes it clear that the respondent authorities may take action against the petitioner for furnishing the alleged fake address and getting his vehicle registered in accordance with law.

Office is directed to enclose a copy of the order, dated 06.04.2017, passed in W.P.No.9570 of 2017 to this order. There shall be no order as to costs.
