THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.39163 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material available on record.
When the matter is taken up, written instructions, dated 02.11.2018, furnished by the Sub Inspector of Police, Kushaiguda Police Station, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, are as under:
"The petitioner herein has sent a petition dated 17.10.2018 through post to the Commissioner of Police, Rachakonda Commissionerate marking copies to the Director General of Police, State of Telangana and 2) The Station House Officer Kushaiguda Police Station requesting to take action against one Ramakrishna and his wife, his follower Giri and two females and two male members who forcibly entered into his house, tried to kill him and threatened to kill her husband and beat her by caught hold of her hand and taken her thumb impressions to extort his property.
Upon receipt of the said petition through post, an entry was made into the Station General Diary, after enquiry into the petitioner, necessary action will be taken.
After enquiry into the petition, a case in Cr.No.792/2018 U/secs.448, 342, 354-A, 506 r/w 34 IPC dated 31.10.2018 was registered on the file of Kushaiguda Police Station, Rachakonda Commissionerate and taken up the investigation into the case.
It is respectfully submitted that the investigation is at the initial stage. Necessary steps will be taken against the concerned accused in the FIR depending on the evidence adduced during the course of investigation into the case. I assure to this Hon'ble Court that the investigation will be completed as expeditiously as possible.
It is pertinent to submit that action was taken on the complaint of the petitioner herein by way of registration of the above FIR No.792/2018 U/secs.448, 342, 354-A, 506 r/w 34 IPC and taken up the investigation into the case. Some delay has caused in taking action on the complaints of the petitioner herein and the delay is neither willful nor wanton, for which, I seek pardon of this Hon'ble Court".
By placing on record the above written instructions, Writ Petition is disposed of, directing the respondents to act strictly in accordance with law. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
