HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.11522 of 2018 ORDER:
The petitioner is the de facto complainant-LW1 in S.C.No.113 of 2013 pending on the file of the learned X Additional District & Sessions Judge, Gurajala, Guntur District, which is outcome of P.R.C.No.1 of 2013 from Crime No.83 of 2013 of Gurajala Police Station registered for the offences punishable under Sections 147, 148, 120B & 302 r/w 149 IPC.

There are as many as fifteen accused, of whom A14 shown died by name Dasari Guravaiah and there are two deceased persons who were allegedly murdered. In all there are eighteen witnesses as per the charge sheet. It is the grievance of the complainant-petitioner that no charges so far even framed by the learned Sessions Judge and the petitioner require early disposal. In fact, that is also the mandate of Section 309 Cr.P.C., subject to other priorities before the trial Court. 3.
Accordingly and in the result, this Criminal Petition is disposed of by directing the learned Magistrate concerned to consider for hearing before charges and if at all any charges framed against any of the accused for any of the offences, to proceed for trial by giving schedule as early as possible.
