Heard.

The petitioner questions the report of the 4th respondent given to the 2nd respondent as the Human Rights Commission appears to have called for a report from the 2nd respondent on the action taken against the encroachers, who have allegedly encroached the land allotted to Gundla Dalmalki Community people for burial ground purpose. The 2nd respondent appears to have called for a report from the 4th respondent, who in turn submitted a report to the 2nd respondent on 29-07-2015. The present writ petition is filed questioning the said report.

I am unable to understand how an administrative report submitted by the subordinate officer to the higher, superior officer would be subjected to judicial review under Article 226 of the Constitution of India. The said report may or may not be accepted by the 2nd respondent and the issue is pending before the Human Rights Commission in HRC No.3631/15. Hence, at this stage, there appears to be neither any cause of action nor any basis to exercise the power of judicial review over the said report. Accordingly, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
