The petitioner has come up with the above writ petition challenging a notice issued by the Authorized Officer proposing to bring the secured asset to sale.

2. Heard Mr. Mohd. Ghulam Rasool, learned counsel for the petitioner and Mr. Prabhandham Balaji, learned counsel for the respondent.

3. It was the case of the petitioner that auction was scheduled on 05.11.2018. But admittedly the auction did not go on. According to the learned counsel for the Bank, they have issued a notice under Rule 9(1) of the Security Interest (Enforcement) Rules, 2002 only now, fixing the date of auction as 09.12.2018. Therefore, nothing survives for adjudication in this writ petition. Hence it is closed. It will be open to the petitioner to work out his remedies against the notice now issued, before the appropriate forum. There shall be no order as to costs.

4. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
