The complaint of the writ petitioner is that the land of an extent of Ac.1.16 cents in Sy.No.690/2 of Chinthalacheruvu village which has been earmarked as an assigned land is proposed to be assigned in favour of various beneficiaries. However, many of the persons who have been identified for the purpose of granting pattas are ineligible. In those circumstances, the petitioner submits that he had made a representation on 5.11.2016 along with other villagers. The same is not being disposed of.

Heard the learned counsel for the petitioner who asserts that it is only on account of the elections in the year 2014, 33 ineligible persons were identified and pattas were granted in their favour. Number of complaints were made to the concerned authorities giving the details of such ineligible persons, but no action has been taken. Though the petitioner is eligible for grant of such patta, he has not been considered for such grant so far.

Having regard to the nature of relief which the petitioner is seeking, this Writ Petition is disposed of with a direction to

the respondents to consider the eligibility of the petitioner and take appropriate action for grant of house site patta. 4.

In so far as the relief which the petitioner seeks to conduct a roving enquiry is concerned, this Court is not inclined to make such order, as admittedly allotments were made as far back as in the year 2014. However, it is open to the petitioner to specifically bring to the notice of the authorities with respect to the individuals who were otherwise not eligible to be granted house site pattas, which shall be considered by the authorities and appropriate action shall be taken by following due process of law.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
