THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.39258 of 2018 ORDER:
When the matter is taken up, written instructions furnished by the Passport Office, Hyderabad, dated 08.11.2018, are placed on record by the learned Additional Standing Counsel. The said written instructions read as under:- "1) As per this respondent office records, the petitioner has obtained passport bearing No.K494363, dated 21.12.1991, with date of birth as 08.03.1982.
2) The petitioner neither submitted representation nor applied for reissue of passport for change of date of birth.
3) As per section 5 of the Passport Act, the petitioner has to file an application for issue of a passport as prescribed. Section 5 of the Passport Act may read as "An application for the issue of a passport under this Act for visiting such foreign country or countries (not being a named foreign country) as may be specified in the application may be made to the passport authority and shall be accompanied by (such fee as may be prescribed to meet the expenses incurred on special security paper, printing, lamination and other connected miscellaneous services in issuing passports (Annexure-I).
4) If the petitioner approaches this petitioner office for reissue of the passport for collection of date of birth by submitting form with relevant documents, this Office would process the application as per the extant rules." Having regard to the contents of the said written instructions, leaving it open for the petitioner to file an appropriate application before the respondent-authorities along with the
relevant documents for consideration of the same by the respondents, the Writ Petition stands disposed of. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. No costs.
