THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRI T PETI TI ON No.35548 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondents. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed with the following prayer:

"to issue a writ of mandamus or any other appropriate writ order or direction declaring the action of the 3rd respondent in not considering petitioner's request for mutation of his name in Revenue Records in respect of the land to an extent of Ac.4.45 cents in R.S.No.449/1 of Pangidigudem village, Dwaraka Tirumala Mandal, W.G.District as per application dated 03-09-2016 as illegal, arbitrary and contrary to law and consequently direct the 3rd respondent to consider petitioner's application dated 03-09-2016, update the revenue records with his name in respect of the said land and issue pattadar passbook and title deed by effecting necessary corrections."

3.

Grievance of the petitioner is that he made an application dated 03.09.2016 for mutation of his name in revenue records, but till date no orders are passed on the said application. 4.

Learned Government Pleader for Revenue would submit that mere filing of a representation is not sufficient as the request has to

CPK,J WP_35548_2016 be made under Form 6(A) after paying requisite charges through Mee-Seva. It is urged that since the same is not done, the Mandal Revenue Officer might be refusing to carry out the mutation. The said fact of non-compliance of procedure is not disputed by the learned counsel for the petitioner.

5.

Having regard to the above, the Writ Petition is disposed of directing the petitioner to make an application under Form 6(A) through Mee-seva by paying requisite charge, for mutating the names of the petitioner in the revenue records in respect of the subject land, in which event, the same shall be dealt with by the Mandal Revenue Officer in accordance with law. 6.

Accordingly, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _______________________ JUSTI CE C. PRAVEEN KUMAR Date:21.10.2016 INL
