Godla Venkatamuni, v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23646 OF 2016 ORDER:
The case of the petitioner is that the petitioner filed revision along with stay petition under Section 9 of A.P. Rights in Land and Pattadar Passbooks Act (for short " the Act") against the orders of 3rd respondent dated 21-07-2015 passed under Section 5 of the Act and the 2nd respondent granted stay until further orders. Meanwhile, the 4th respondent issued notice dated 16-09-2015 for implementation of the orders of 3rd respondent dated 21-07-2015. When writ petition came up for hearing, this Court granted interim stay and the same was extended from time to time. Counter affidavit and Vacate stay petition is filed.
As the revision under Section 9 of the Act is pending before the 2nd respondent, this Court is not inclined to go into the merits of the case and both counsel state that a direction may be given to the 2nd respondent to dispose of the revision. In view of the same, the 2nd respondent is directed to dispose of the revision filed by the petitioner after issuing notice to the petitioner as well as the 5th respondent in accordance with law within a period of two months from the date of receipt of a copy of this order. Till disposal of the revision, there shall be status-quo regarding entries of the subject land in revenue records.
With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 04-04-2017 Nvl
