HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO CIVIL REVISION PETITION NO. 235 OF 2015 ORDER:

When the case is called none appeared for the petitioner. A perusal of papers in the present case reveals that the petitioners are defendants in O.S.No. 1090 of 2014. When an order was passed in I.A.No. 1810 of 2014 on 19.12.2014, at the instance of the plaintiff, directing the petitioners herein to furnish third party security to the suit claim amount within 48 hours, the present Civil Revision Petition was filed.

The said order was passed on 19.12.2014 and I.A. itself was posted to 24.12.2014. Subsequently, on 26.12.2014, after filing Vakalat for the petitioners herein and after hearing both parties and in the absence of furnishing any security, the attachment was made absolute.

In the above facts and circumstances of the case, this Court does not see any ground to interfere with the order passed by the trial Court. However, liberty is given to the petitioners to file an appropriate application in the trial Court, if they want to see that attachment is raised.

Accordingly, the Civil Revision Petition is dismissed at the stage of admission. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed. There shall be no order as to costs.
