ORDER:

This writ petition is filed for the following substantive relief: "...to issue any appropriate Writ, Order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents herein in obstructing and interfering with the execution work allotted to the petitioner society vide orders dated 25-112015, vide proceedings No. ... in respect of Thotada Ramp, situated in Amadalavasa Mandal, Srikakulam District, without following due process of law as illegal, arbitrary,

highhanded and violation of principles of natural justice and consequently direct the respondents to permit the petitioner to lift the sand from the Thotada Ramp till fulfilment of the contract entered into to deliver 693 loads to the customers by permitting the petitioner to complete the pending delivery loads in the interest of justice and equity." At the hearing, Mr. M. Krishna Rao, learned counsel for the petitioner, requested for permission to withdraw the writ petition with liberty to his client to file a fresh writ petition.

The writ petition is accordingly dismissed as withdrawn with the liberty in terms of the prayer made.

As a sequel to dismissal of the writ petition, W.P.M.P. No.2889 of 2016 shall stand disposed of as infructuous.
