JUDGMENT:

The purported lessee of the suit schedule property in respect of which a decree for declaration of title and recovery of possession was passed, filed a claim petition under Order XXI Rule 97 CPC. After a full fledged trial, the trial Court dismissed the claim petition mainly on the ground that the purported lease deed set up by the claimant is not admissible in evidence in view of Section 17 of the Registration Act, 1908 as the lease deed was not registered. The appellate Court has confirmed the said finding. Feeling aggrieved by the Judgments of both the Courts below, the appellant has filed this Second Appeal. After hearing Mr. Ravi Shankar Jandhyala, the learned Counsel for the appellant, and perusing the Judgments of the trial Court as well as the appellate Court, I am of the opinion that no substantial question of law arises for consideration in this Second Appeal. Hence, the Second Appeal is dismissed. As a sequel to the dismissal of the Second Appeal, SAMP No.1996 of 2015 is dismissed as infructuous.
