Sujatha Pradhan v. The State Of Andhra Pradesh,
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:34884 OF 2016 ORDER:
1.
The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, challenging the action of the 2nd respondent in not returning her original caste certificate. 2.
Heard and perused the material available on record. 3.
The main grievance of the petitioner is that the 2nd respondent took the original caste certificate of the petitioner under acknowledgement on 21.4.2008 for the purpose of enquiry. But even though the enquiry was completed, the 2nd respondent has not returned her original caste certificate in spite of many representations.
4.
It is brought to the notice of this Court that the enquiry is pending and the certificate of the petitioner is also with the 2nd respondent. Considering the date on which the certificate was taken by the 2nd respondent, the 2nd respondent is directed to conclude the enquiry, within a period of three months from the date of receipt of a copy of this order, and return the original caste certificate of the petitioner in Serial No.780143, dated ...5.1999 issued by the 3rd respondent, subject to the result of the enquiry.
5.
With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ____________________ JUSTICE RAJA ELANGO Dated: 18th October, 2016 Nn.
