ORDER:- Heard learned counsel for the petitioner and learned government pleader for revenue.

2. An order of resumption was passed against the petitioner by the third respondent in Rc.No.133/2014 dated 04.06.2015. Petitioner preferred an appeal against the said order on 04.07.2015 along with the stay petition, which is stated to be pending before the Revenue Divisional Officer (RDO), second respondent, and on the said appeal and the stay petition two dates of hearings were given by the second respondent on 07.08.2015 and 22.08.2015. However, since the officer was not present, the appeal could not be taken up. Petitioner now questions the order of the Tahsildar and the inaction on the part of the second respondent.

3. In the facts and circumstances of the case, writ petition is disposed of directing the second respondent to fix an early date in the appeal and pass appropriate orders at least to the extent of stay petition within a week from the date of receipt of this order As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
