Smt. G. Hemalatha v. The State Of Telangana,

2018-10-31C.Praveen Kumar2 pages

HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39183 of 2018 ORDER:

1) Heard learned counsel for the petitioners and Sri N.Praveen Kumar, learned Standing Counsel appearing for respondent No.2. Since this Court is not going into merits of the case, it may not be necessary to issue notice to the unofficial respondents. 2) The present writ petition came to be filed questioning the action of respondent No.2 in processing the building application of respondent Nos.6 to 8, in respect of the land admeasuring Acs.4.00 guntas in Survey Nos.81 and 82, situated at Boduppal Village, Ghatkesar Mandal, Ranga Reddy District, as illegal and arbitrary. 3) Though various grounds are raised, learned counsel for the petitioners would submit that on 24.09.2018, petitioner No.1 made an application objecting the building permission given to the unofficial respondents for the land referred to above. The grievance of the petitioners appears to be that the authorities may process the application of the unofficial respondents, without considering the objections filed by the petitioners.

4) Learned Standing Counsel would submit that if such objections are already filed and if no orders are passed, the authorities shall definitely take into consideration the objections along with the documents.

5) Having regard to the above, the writ petition is disposed of directing respondent No.2 to take into consideration the objections dated 24.09.2018, made by petitioner No.1, along with documents in support of the same, and pass appropriate orders, if not already passed, in accordance with law, after hearing the petitioners and the unofficial respondents.

6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. ______________________________ JUSTICE C. PRAVEEN KUMAR 31.10.2018 Note:

Issue CC by tomorrow.
