Poloji Veerachary v. The State Of Telangana
HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Petition No.36932 of 2017 ORDER:
This Writ Petition is filed by the petitioner seeking Writ of Mandamus declaring the inaction of the 1st respondent in not disposing of the Appeal No.7769/TW.CV.2/2011 pending before it as illegal and arbitrary and to give a direction to the respondents to dispose of the appeal at the earliest. 2) The grievance of the petitioner is that against the order of the 2nd respondent, the petitioner herein has filed an Appeal No.7769/TW.CV.2/ 2011 before the 1st respondent in the year 2011 and the same was heard from time to time and finally on 17.12.2016 and the petitioner has already submitted his written arguments in the said matter but unfortunately the appeal has not been disposed of so far.
3) Learned Government Pleader for Social Welfare (Telangana) having received notice, not disputed about the factum of pendency of the appeal but however requested the Court to fix a reasonable time for disposal of the mater. 4) In that view, the 1st respondent is directed to dispose of the Appeal No.7769/TW.CV.2/2011 on merits within a period of three (3) months from the date of receipt of a copy of this order.
5) Accordingly, this Writ Petition is disposed of. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed. _________________________ U.DURGA PRASAD RAO, J Date: 03.11.2017 Note: Issue C.C by 06.11.2017 (b/o) scs
