HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.2013 of 2015 in Crl.P.No.1849 of 2015 and Criminal Petition No.1849 of 2015 COMMON ORDER:

The defacto complainant and her counsel Sri G.V.R.V. Reddy are present. A.1 to A.3 and their Counsel Sri K.L.Sastry are present.

Heard both sides and perused the petition.

On the report given by the defacto complainant, the police of Raidurgam P.S, Cyberabad registered FIR No.444 of 2014 against the accused for the offence under Sec.420, 498A, 406 IPC and 156(3) Cr.P.C and investigation is reported to be pending.

While so, both parties and their Counsel present today before Court and submitted that they have amicably resolved all their disputes at the intervention of elders as per which the defacto complainant and A.1 agreed to obtain divorce and in fact they have obtained divorce by mutual consent by filing O.P.No.1504 of 2014 before the Judge, Family Court, City Civil Court, Hyderabad on 16.02.2015 and the maintenance claim of the defacto complainant was also taken care and A.1 paid an amount of Rs.7,00,000/- to her by way of D.D at the time of filing the divorce petition.

In view of these the defacto complainant has no objection for quashment of the proceedings in Crime No.444 of 2014 on the file of Raidurgam

P.S, Cyberabad and so the Court may be pleased to accord permission to the parties to compound the offence and accordingly quash the proceedings in the interest of justice. Having regard to the above submission and in view of the fact that it is a matrimonial matter wherein the parties have amicably resolved their disputes, no useful purpose will be served even if the investigation is ordered to be continued since they have compromised and following the decision reported in Gian Singh vs. State of Punjab and another[1] this petition is allowed and permission is accorded to the parties to compound the offence and proceedings in Crime No.444 of 2014 on the file of Raidurgam P.S, Cyberabad are hereby quashed.

In the result, both the petitions are accordingly allowed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
